2. Service Description
MonitorMate is an advanced device management and monitoring application that allows you to:
- Monitor and track device location via GPS
- View call logs and SMS/MMS messages
- Access photos, videos, and media files
- Monitor app usage and browser history
- Track social media activity and messages
- Record ambient audio and video (where legally permitted)
- View contacts, calendar events, and clipboard data
- Receive notifications about device activity
Data Collection & Transmission:
You are aware that this application can record, collect, and transmit information about phone usage and user activity. This data will be sent to our secure servers via the HTTPS protocol for your review through the dashboard.
3. Permitted Use
You are allowed to use this application ONLY under the following conditions:
- Device Ownership: You are using this application on a device that you own and personally use;
- Explicit Consent: You have explicit written consent from the owner and all users of the device to be monitored;
- Legal Guardian Rights: You are a legal guardian of a minor who uses the device to be monitored;
- Employee Monitoring: You are an employer monitoring company-owned devices with proper employee notification and consent as required by local laws.
Legal Compliance:
You acknowledge that you know and comply with all laws and regulations that cover privacy, confidentiality, and the use of monitoring applications in your local jurisdiction. You assume full responsibility for installing or using the application in accordance with applicable laws.
4. Prohibited Uses
You agree NOT to use MonitorMate for:
- Monitoring devices without proper authorization or consent
- Stalking, harassment, or any illegal surveillance activities
- Violating anyone's privacy rights or applicable privacy laws
- Monitoring devices owned by others without their knowledge (except as legally permitted for parental monitoring of minors)
- Any purpose that violates local, state, national, or international laws
- Commercial espionage or competitive intelligence gathering
- Unauthorized access to private communications
5. Data Collection Consent Policy
MonitorMate allows you to control whether data is sent to our servers. You understand that:
- You can enable or disable data transmission at any time via the app settings
- Each time data is collected and sent, a notification will inform you of the action (if notifications are enabled)
- You have full transparency and control over device activity monitoring
- Data is transmitted securely using industry-standard encryption (HTTPS/TLS)
- You can request data deletion at any time through your account settings
6. User Responsibilities
As a user of MonitorMate, you agree to:
- Provide accurate registration and account information
- Maintain the security of your account credentials
- Notify monitored individuals as required by applicable laws
- Comply with all applicable laws regarding data privacy and monitoring
- Use the Service only for legitimate and lawful purposes
- Obtain and maintain all necessary consents from monitored individuals
- Keep your app updated to the latest version for security purposes
7. Limitation of Liability
You acknowledge that MonitorMate and its affiliates shall not be liable for:
- Any damages, litigation, or other legal actions arising out of your installation or use of the Service
- Any misuse of the Service by you or third parties
- Any violation of laws or regulations by users of the Service
- Loss of data due to technical issues, user error, or third-party interference
- Interruption of service, delays, or technical malfunctions
- Actions taken by you based on data collected through the Service
- Unauthorized access to your account or monitored data
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Data Security & Privacy
We take data security seriously and implement industry-standard measures to protect your data:
- All data transmission is encrypted using HTTPS/TLS protocols
- Data is stored on secure servers with access controls
- We do not sell or share your monitoring data with third parties
- You maintain ownership of all collected data

9. Subscription & Payments
MonitorMate offers subscription-based services:
- Subscriptions are billed monthly or annually based on your selection
- Payments are processed securely through Paystack
- You can cancel your subscription at any time
- Cancellations take effect at the end of the current billing period
- Refunds are subject to our Refund Policy
- We reserve the right to modify pricing with notice to existing subscribers
10. Termination
We reserve the right to terminate or suspend your account and access to the Service:
- For violation of these Terms and Conditions
- For illegal or unauthorized use of the Service
- For non-payment of subscription fees
- For abusive behavior towards our staff or other users
- At our discretion with or without notice
You may terminate your account at any time through your account settings or by contacting support.
11. Intellectual Property
All content, features, and functionality of MonitorMate, including but not limited to:
- Software code, design, and user interface
- Trademarks, logos, and brand elements
- Documentation and user guides
- All proprietary technology and algorithms
are owned by MonitorMate and are protected by international copyright, trademark, patent, and other intellectual property laws.
12. Updates & Modifications
We reserve the right to:
- Modify or update these Terms and Conditions at any time
- Update the Service features and functionality
- Change subscription pricing with reasonable notice
- Discontinue features or the Service with notice
Continued use of the Service after changes constitutes acceptance of the modified terms. We will notify you of significant changes via email or in-app notifications.
13. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

For users in the European Union, MonitorMate complies with the General Data Protection Regulation (GDPR):
- You have the right to access your personal data
- You can request correction of inaccurate data
- You can request deletion of your data (right to be forgotten)

16. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties regarding accuracy, reliability, or availability of the Service
- Warranties that the Service will be uninterrupted or error-free
- Warranties regarding the security of data transmission or storage
17. Indemnification
You agree to indemnify, defend, and hold harmless MonitorMate, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service

- Your violation of any rights of another party
